Opticare Inc. (“Opticare”, “Opticare AI”, “we”, or “our”) provides a proprietary health and wellness management system, which includes a fundus camera device, web interface, and related communications services such as SMS and Email (collectively referred to as the "Opticare System" or “System”). The System is designed to assist users (“you”) in self-managing your health and wellness. This Privacy Statement explains how we collect, use, disclose, and otherwise process personal information in connection with the Opticare System.

This Privacy Statement applies specifically to the Opticare System and does not govern:

(a) any websites, mobile applications, or other online services that do not link to this Privacy Statement; (b) the processing of personal information by any third parties not involved in the provision of the Opticare System; (c) our processing of personal information in connection with any other services or products offered by Opticare.

Personal Information Opticare Collects

Information You Provide: You may provide us with the following categories of information depending upon your relationship to the System:

Contact information, such as name, email address, mailing address, and phone number.
Account information, such as username and password used to establish an online account with Opticare.
Demographic information, such as your city, state, country of residence, postal code, date of birth, and age.
Correspondence information, such as information provided in connection with questions, feedback, or other interaction with us through the System.
User-generated or Opticare device-generated content information, such as fundus images, comments, questions, messages, images, video, and other content or information that you or Opticare generate, transmit, or otherwise make available on the System, as well as associated metadata. Metadata includes information on how, when, where, and by whom a piece of content was collected and how that content has been formatted or edited. It also includes additional data added by users, such as keywords and location information.
Relationship information, such as familial or other relationships to third parties whose personal information you may provide to us, like emergency contact information.
Health information, such as medical conditions, prescriptions, or symptoms that you voluntarily upload to the System. By submitting health-related information to the Opticare System, you explicitly consent to the collection, use, and sharing of your health information as described in this Privacy Statement. You have the right to withdraw your consent at any time by contacting us at support@opticare.ai.

How Opticare Uses Your Information

We primarily use your information to provide you with the System and our services. Additionally, we may use your information for related purposes, such as to:

Maintain, improve, and develop our services and business.
Enforce Opticare’s terms and conditions, rights, safety, or property and/or those of you or others.
Provide information about the System such as updates or changes to the System and security alerts.
Comply with the law.
Protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or illegal activity.
Create anonymous, aggregated, or de-identified data by removing identifiers that make the information personally identifiable to you. We may use and share this non-personal information for our lawful business purposes.

How Opticare Shares Your Personal Information

At Your Direction: Opticare may share your information with third parties to facilitate your use of the System and our services. For example, we may share your information with individuals you designate in the System to enable correspondence through the System.
With Third-Party or Affiliate Service Providers: Opticare may share your information with third-party or affiliate service providers that perform services for or on behalf of Opticare for the purposes described in this Privacy Statement. We share your data with third parties only in scenarios such as communication with you through email or sms, services for data analytics and inference. All third-party partners are obligated to provide data protection standards equivalent to ours.
In Connection with Corporate Transactions: Opticare may share some or all of your information in connection with or during negotiation of any merger, financing, acquisition, dissolution transaction, or in the event of an insolvency, bankruptcy, or receivership.

We do not disclose your contact information to third parties for their own marketing purposes. Opticare does not sell your personal data under Washington or Nevada law.

Opticare recognizes and upholds your rights under various data protection laws, such as the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR).

Your Rights Under CCPA: If you are a California resident, you have rights to access, know, and request deletion of your personal information, among others.

Your Rights Under GDPR: If you are a resident of the European Union, you have rights to access, correct, delete, restrict processing, and port your data, among others.
